Lease optional dog parks were created so that the animals can run free without the worry of joggers, elderly, or children. However, risks still exist for possible dog bites or injuries.

In a dog park where the owner is not required to use a leash, it would be hard for a victim of a dog bite in Idaho to claim that the owner was negligent. Still, negligence can be defined as doing something without reason or unreasonably failing to do something that should have been done. In this case, if an owner enters a leash optional park knowing the dog if vicious, dangerous or not socialized and still does not leash or control the animal, the owner may be at fault if an injury occurs.

Those who make claims against the local government for a dog bite sustained at a leash optional dog parks fight a difficult case. Many local governments hold immunity if they provided a service or area thought to be beneficial to the community. However, this immunity can be voided if the government fails to enforce rules in the dog park. If a dog owner constantly breaks these rules, animal control ignores this problem and the dog injures another human being, the government can be found liable.

Adults who enter dog parks assume that there may be a risk of injury because the dogs are unleashed.
